Civil Rights Litigation

  Our civil rights practice focuses on two distinct type of cases:

 

1) Cases arising from injuries to children while they are under the care, custody, and control of the government, i.e., children injured in foster care or group placement; and,

 

2) Cases related to familial rights and the protection of families (children and parents) against the overreach of government agencies, particularly Child Protective Services (CPS).

  With respect to our work protecting children in foster care, the firm has successfully represented children who were severely injured, sexually abused, or even killed in foster care. In addition to representing children injured in foster care, our firm has successfully litigated numerous cases involving the violation of constitutional rights, including the right to due process and the right to parent one's own children, as well as a child's right to be parented by their biological parents. Our work often involves representing parents and families who have been wrongfully accused or had their parental rights violated by CPS. Mr. McMillan has won multiple multi-million dollar jury verdicts in civil rights cases and has been recognized for his trial advocacy and civil rights work.

  Our attorneys have won multiple awards for our pioneering work in protecting the rights of children and families, including the "Street Fighter of the Year" award from the Consumer Attorneys of California, the "Top Gun" trial attorney in the area of Civil Rights by the Orange County Trial Lawyers Association, California Lawyer magazine's Clay award, as well as Consumer Attorneys of San Diego's Outstanding Trial Attorney award.
